Glass Doctor Infringement Case Upheld; Damages to
be Reassessed
The 4th U.S. Circuit Court of Appeals has ruled that a Norfolk,
Va., federal court did not err in the case of Synergistic International
LLC v. Korman in ruling that the defendant's trademark (The Windshield
Doctor) infringed on the plantiff's trademark (Glass Doctor). However,
the court of appeals did vacate the district court's damage award
of $142,000. The case has been remanded for a reassessment of damages.
